A Joe Biden Judge Just Handed Letitia James the Biggest Loss of Her Political Career

Letitia James stood outside a Manhattan courthouse last February and declared that she'd just stopped DOGE cold.

But the same judge who gave her that win just threw out her entire case.

And a Joe Biden judge just handed Letitia James the biggest loss of her political career.

DOGE Did the Work While James Did the Press Conferences

A Biden-appointed federal judge – Judge Jeannette Vargas – dismissed James' DOGE Treasury lawsuit Wednesday.

Not ruled against her.

Dismissed it as moot.

The political translation: DOGE won, James wasted nearly two years of taxpayer money, and the court just made that official.

The judge noted that BFS “functions as the central payment clearinghouse for all payments to and from federal agencies,” “is responsible for providing reimbursement directly to the States for Congressionally mandated programs,” and “maintains sensitive and confidential financial information, including the States’ banking account numbers.”

She also dismissed the states’ challenge to the DOGE team’s creation of an “automatic system capable of pausing federal funding otherwise due to the States.”

The DOGE Temporary Organization completed its mission and closed on July 4, 2026, exactly as Trump's executive order directed.

No DOGE employees remain at Treasury.

No court can stop access that no longer exists.

James had led 18 other Democrat attorneys general in this crusade, all of them claiming Trump had handed the "keys to the Treasury" to unvetted outsiders putting sensitive financial data at risk.

Vargas herself initially sided with them – granting a preliminary injunction in February 2025 that blocked DOGE access, then modifying it repeatedly as the Trump administration put employees through proper vetting, training, and security clearance protocols.

In other words, while James held press conferences, Trump fixed the thing she was screaming about and kept building.

The Judge James Thought Was Her Ally

Vargas was her judge.

Biden nominated her in March 2024.

The Senate confirmed her that September – four months before Trump's inauguration.

James filed in Vargas' court expecting a sympathetic bench.

What she got was a judge who followed the law.

When DOGE finished its work and the Treasury team disbanded, Vargas ruled exactly as any honest judge would: there's nothing left to enjoin.

She also separately dismissed the states' claims about an automated payment-review system, finding that not one of the 19 attorneys general could identify a single dollar their states had actually lost.

Not one.

Nineteen attorneys general, nearly two years of litigation, and not a single state could show their residents lost a dime.

That's not a legal setback.

That's a case that should never have been filed.

The Pattern James Hoped You'd Forget

Letitia James has been running the same play since 2018 – file lawsuit, hold press conference, declare victory, move on before the outcome.

Her 2022 civil fraud case against Trump produced a penalty north of $450 million that an appeals court later voided.

Her crusade against the Trump Organization ended with convictions that never touched Trump personally.

She campaigned on investigating Trump Tower before he was even charged with anything.

And now she led a 19-state coalition against DOGE, won a preliminary injunction she celebrated as a landmark victory – and watched it collapse the moment DOGE did exactly what it was always going to do: finish the job and shut down on schedule.

Trump's executive order set out to expose fraud, waste, and abuse across federal agencies, with a hard deadline of July 4 to get it done.

DOGE hit the deadline.

James hit a dismissal order.

That's the whole story.
