Democrats were counting on the Justice Department investigation into the events of January 6 to smear the GOP as the Party of sedition and scare swing voters into supporting keeping the Left in power.

U.S. District Court Judge Trevor McFadden dealt that effort a severe blow by acquitting Matthew Martin on charges of entering the Capitol.

Martin argued he thought police allowed him into the building, and Judge McFadden felt the government did not prove its case beyond a reasonable doubt.

“Following a two-day bench trial in U.S. District Court in Washington, New Mexico engineer Matthew Martin was acquitted Wednesday on four misdemeanor charges by U.S. District Court Judge Trevor McFadden. Martin claimed that he thought the police had allowed him into an entrance near the Capitol Rotunda on Jan. 6, 2021,” POLITICO reported.

“McFadden said that, based on video of the scene, that assertion was at least ‘plausible’ and that prosecutors failed to prove the case beyond a reasonable doubt,” POLITICO continued.

“‘People were streaming by and the officers made no attempt to stop the people,’ said the judge, an appointee of President Donald Trump,” POLITICO continued.

“Prosecutors argued that broken windows and blaring alarms should have alerted Martin that he did not have permission to enter, but McFadden said the sheer size of the crowd coupled with the conduct of the police undermined that evidence,” POLITICO concluded.

There is a massive amount of footage showing police officers standing by open doors at the Capitol doing nothing to stop the crowd from entering.

Judge McFadden stated he believed it was reasonable that Martin believed the police officers were allowing demonstrators into the Capitol.

Prosecutors did not accuse Martin of committing any violence, as he merely milled around the building and never taunted or engaged with police officers.

This verdict will make it more difficult for the government to win convictions against Trump supporters who walked into the Capitol and committed no acts of violence.

Judge McFadden’s verdict also undercuts the claims by the government that this is the largest investigation in history trying to round up all the guilty parties in a violent insurrection to overthrow the government.
