Liberal judges have spent four years using asylum law as a wrecking ball against deportations.
Now the Supreme Court just took that wrecking ball away.
And the justice who swung the hammer was Biden's own pick – the one Democrats said would protect their legacy.
Jackson Writes the 9-0 Asylum Ruling That Ends the Liberal Court Loophole
Justice Ketanji Brown Jackson – confirmed by Democrats to be the progressive firewall on the Court – just authored a unanimous 9-0 ruling that guts the strategy liberal lawyers have used to flood the courts and stall Trump's deportation machine.
The case, Urias-Orellana v. Bondi, centered on a Salvadoran family who entered the country illegally in 2021 and claimed a hitman was targeting them back home.
The immigration judge heard the case, found the man credible – and still denied asylum.
Why?
Because threats and demands for money, even from a hitman, don't automatically rise to the legal definition of "persecution."
That ruling went up the chain.
The Board of Immigration Appeals agreed.
The First Circuit agreed.
Then pro-migration lawyers took it to the Supreme Court, betting that Jackson and the liberal bloc would blow open the definition of persecution – making it easier for federal judges to override immigration courts and block deportations.
They bet wrong.
Jackson wrote that immigration law requires federal courts to use a "substantial-evidence standard" when reviewing what immigration judges decide.
That means a federal judge can only overrule an immigration court if the evidence was so overwhelming that no reasonable person could reach the same conclusion the immigration judge reached.
"The agency's determination is generally conclusive," Jackson wrote, "unless any reasonable adjudicator would be compelled to conclude to the contrary."
Translation: federal judges don't get to substitute their own judgment for what trained immigration judges decided.
The executive branch runs immigration courts. Federal judges – many of them Biden and Obama appointees – don't get a second bite at the apple.
How the Supreme Court Just Locked Liberal Judges Out of Asylum Appeals
For years, liberal lawyers ran the same play.
Lose at the immigration judge level.
Lose at the Board of Immigration Appeals.
Then take the case to a sympathetic circuit court and ask a friendly judge to review the persecution question as a fresh legal issue – bypassing the immigration judge's findings entirely.

Judges in six circuits – the Second, Third, Fifth, Eighth, Ninth, and Eleventh – had all decided, in various forms, that they could conduct that independent review.
That's over now.
The unanimous ruling means every circuit in the country must apply the same deferential standard.
The immigration judge's finding stands unless it's egregiously wrong.
Legal analyst Jonathan Turley called the decision "a win for the Trump Administration in maintaining a high burden to overturn immigration courts in asylum cases."
This matters because Trump has been systematically replacing pro-migrant immigration judges with judges who apply the law as written.
Asylum approval rates have already collapsed from roughly 50 percent in 2023 to under 10 percent by late 2025.
This ruling ensures that liberal circuit courts can't reverse that trend by manipulating the standard of review.
The Deportation Delay Machine Biden Built and Trump Just Dismantled
Here's what your local news won't explain.
The asylum system was never designed to process nearly 900,000 defensive applications a year, which is what Biden created at the southern border.
It was designed as a safety valve for genuine political refugees – people fleeing actual government persecution, not cartel economies or gang-controlled neighborhoods.

Biden's open border turned it into a legal delay machine.
File an asylum claim and you can stay in the country for years while courts process it.
Lose at the immigration judge level? Appeal to the BIA. Lose again?
Take it to a federal circuit court where judges could wipe out the immigration judge's findings and evaluate the case on their own terms.
That process could drag on for years.
The Supreme Court just yanked a critical link out of that chain.
Now when migrants lose their asylum cases – and under Trump's courts they are losing at record rates – their only route to a federal court reversal requires proving the immigration judge was so wrong that no reasonable person could agree with the decision.
That's an almost impossible standard to meet when the immigration judge already found the facts credible and still denied the claim.
Democrats built a system designed to use the courts as a substitute for a border.
Trump is using those same courts to shut it down.
And this week, his opponents' own Supreme Court justice handed him the legal framework to do it.
