And Brett Kavanaugh’s past could come back to haunt Donald Trump in this awful way.
In the 1990s Brett Kavanaugh played a key role working on the Whitewater investigation for independent counsel Ken Starr. That investigation eventually led to Bill Clinton’s impeachment for perjury and obstruction of justice.
Democrats and their allies in the Fake News Media seized one of Starr and Kavanaugh’s findings to make trouble for President Trump — namely that Congress could impeach Bill Clinton over obstruction of Congress charges due to Clinton’s refusal to testify.
The Daily Beast reports:
Starr assigned Kavanaugh to play a key role in authoring Starr’s report to Congress, which included a section setting forth potential bases for impeaching the president; among them was a claim that Clinton should be impeached for going to court to assert the executive privilege in the first place. According to Starr and Kavanaugh, the privilege assertion was itself impeachable, because it was purportedly meritless and Clinton had managed to use the privilege litigation to delay Starr’s investigation. As the Starr Report put it, the temporary delay amounted to an illicit “conceal[ment]” by Clinton of his “personal misconduct.” Starr and Kavanaugh also argued that Clinton should be impeached because he refused to voluntarily testify himself, despite the fact that (unlike Trump) Clinton ultimately testified after receiving a subpoena; once again, mere delay was deemed potentially impeachable.
Democrats are set to make a similar charge against the President.
But Donald Trump is exercising his legal right as an American to petition the courts for relief from what he believes to be an unjust and unconstitutional order from Congress.
If Donald Trump defied a court order, Democrats might have a case.
But Democrats want to impeach the President for making his case in the courts.
The Democrats’ argument falls apart because what Trump is really obstructing is the Democrats’ ability to wrap up impeachment before the voting begins in the 2020 election cycle.
