Senate Majority Leader Chuck Schumer (D-NY) thought he was sitting on top of the world after Democrats’ surprising success in the Midterm elections.
But an illegal campaign payment could come back to haunt Schumer and the Democrats with potential campaign finance charges.
The Democratic Senatorial Campaign Committee (DSCC) is closely connected to Schumer and is the official campaign committee to elect Senate Democrats.
A report from the Washington Free Beacon revealed that the DSCC potentially violated federal campaign finance law by paying an illegal alien for campaign services during the Midterm elections.
Democrats paid $500,000 to Arizona-based La Machine Consulting for canvassing work in three battleground Senate races in the run up to the election.
The consulting firm paid for voter canvassing in Nevada, Georgia, and Arizona, the three most highly contested Senate races.
La Machine Consulting is owned by Antonio Valdovinos, who brags about his status as an “undocumented” immigrant.
Valdovinos is a Deferred Action for Childhood Arrivals (DACA) recipient, a program illegally created by former President Barack Obama that allows the children of illegal aliens to stay in the country.
The Federal Election Commission (FEC) considers DACA recipients as “foreign nationals” under federal campaign finance law.
Under federal campaign finance law, foreign nationals can’t be “directly or indirectly” involved with the “decision-making process” of any political campaign or committee.
As the owner of La Machine Consulting , Valdovinos would almost certainly be involved in the decision making process, especially after receiving a half a million-dollar payment from the DSCC.
Dan Backer, a campaign finance lawyer who has argued and won cases at the Supreme Court, told the Free Beacon that the payment could violate federal campaign finance laws.
“If the DSCC knowingly engaged a non-citizen/resident in a capacity that they are prohibited from participating in for federal election law purposes, then they ought to be held accountable,” Backer said.
Valdovinos has dealt with potential campaign finance violations in the past due to his status as an illegal alien.
In 2021, the FEC investigated him for potential violations before declining to file charges against him because of “prosecutorial discretion.”
The FEC noted that his company’s work “raises the prospect that the company could provide the type of services that the commission has previously found resulted in prohibited foreign national contributions.”
This is the latest campaign finance scandal for Democrats involving payments to illegal aliens.
Bernie Sanders’ (I-VT) 2020 Presidential campaign was fined $15,000 by the FEC for illegally employing three DACA recipients for Hispanic outreach.
