Joe Biden planned to use lawfare against Donald Trump

Joe Biden’s repeatedly leaked to the press his displeasure with Attorney General Merrick Garland not moving fast enough to indict Donald Trump.

On April 1, 2022, The New York Times reported on Biden’s anger at Garland.

“As recently as late last year, Mr. Biden confided to his inner circle that he believed former President Donald J. Trump was a threat to democracy and should be prosecuted, according to two people familiar with his comments,” The Times report began.

“And while the president has never communicated his frustrations directly to Mr. Garland, he has said privately that he wanted Mr. Garland to act less like a ponderous judge and more like a prosecutor who is willing to take decisive action over the events of Jan. 6,” The Times report added.

Of course, a major leak to The New York Times about the President being unhappy the Attorney General isn’t moving quickly enough is the functional equivalent of a direct order to indict Trump.

After Donald Trump successfully delayed the January 6 trial Jack Smith sought in Washington, D.C., Biden again complained to the media about Garland not indicting Trump soon enough.

In recent weeks, President Biden has grumbled to aides and advisers that had Garland moved sooner in his investigation into former President Donald Trump’s election interference, a trial may already be underway or even have concluded, according to two people granted anonymity to discuss private matters,” POLITICO reported on February 9.

Biden believed a criminal conviction against Trump was his only chance to victory.

And Biden was furious the man he tasked with waging lawfare against Trump didn’t get the job done.

Lawfare may not save Joe Biden 

But would a criminal conviction against Trump really hand Biden the election?

A Ledger 360 poll for the New York Post showed Trump beating Biden 46 to 44 percent if Trump is found not guilty in his criminal bases.

If Trump is found guilty but not imprisoned, Biden leads Trump by 5 points, 44 to 39.

Should Trump be found guilty and sent to jail, Biden leads 45 to 37 percent.

In either case of a criminal conviction, no voters actually move to Joe Biden.

Biden’s support is flat.

Some Trump voters move to undecided or third party candidates.

These polls show that it’s highly likely voters think Trump is barred from being President if convicted of a crime.

Polls also show a majority of Americans believe the charges against Trump to be politically motivated.

Once they learn that Trump can be President no matter what, will a criminal conviction they believe is the result of politics stop them from voting for Trump?

The lack of support moving to Biden as the result of a criminal conviction suggests Trump can win these voters back once they learn the truth.
