The Supreme Court is the last branch of government remaining where conservatives hold power.
But that may soon change.
And Joe Biden hit the Supreme Court with a warning that could force Clarence Thomas to retire.
Joe Biden announced the creation of a commission to study reforms on the Supreme Court.
This announcement followed months of Biden refusing to reveal his position on packing the Supreme Court with as many as six new liberal justices.
Writing in The Daily Caller, Ellie Gardy wrote that this commission was really nothing but blackmail.
In the piece, Gardy argued that Biden would hold recommendations to alter the makeup of the Supreme Court over Chief Justice John Roberts’ head as a threat to force conservative justices to rule in the Biden administration’s favor.
Gardy wrote:
President Joe Biden has issued a thinly veiled threat to Chief Justice John Roberts in the form of a new commission that will study Supreme Court reform. The threat is clear: if Roberts doesn’t limit the court’s conservative influence on key issues like abortion, gun rights and immigration, Democrats will pack the court.
In other words, “Nice court ya got there, it would be a shame if something happened to it.”
In 2012, this bullying strategy paid off for Barack Obama.
Before the Supreme Court handed down its decision on the constitutionality of Obamacare’s individual mandate, Obama repeatedly warned the court not to overturn the law.
Roberts eventually folded under the pressure and appeared to have changed his vote from striking down the Obamacare mandate to upholding the law.
Court packing is not the only tool Biden’s commission could come up with to change the composition of the Supreme Court.
Biden’s commission could also recommend Congress pass term limits for Supreme Court justices, which would force Clarence Thomas – who is currently the longest serving justice – to be the first member of the Supreme Court forced into mandatory retirement.
