Donald Trump sued the January 6 committee and the National Archivist for the committee’s demands that the archivist turn over thousands of pages of documents from April of last year up to the end of Trump’s presidency.
“The Committee’s request amounts to nothing less than a vexatious, illegal fishing expedition openly endorsed by Biden and designed to unconstitutionally investigate President Trump and his administration,” Trump’s lawsuit read.
The committee is on a witch hunt to discredit Donald Trump ahead of an expected 2024 Presidential campaign.
Trump claimed executive privilege to block the request, but the Biden administration claimed a former President does not have such a right.
But while Biden could not support Trump’s claim or risk losing the support of his base, the Biden administration may be secretly hoping Trump prevails in his lawsuit.
If Trump loses and the courts weaken the right of executive privilege, that could come back to haunt Joe Biden should Republicans win back the House and Senate in next year’s midterm elections.
“An incumbent administration does not have the constitutional authority to unilaterally waive the executive privilege of a previous administration—especially one so recent,” a memo from Trump’s lawyers about the lawsuit read. “If it did, then executive privilege doesn’t exist, including for Joe Biden.”
A new GOP-run Congress could exploit the Biden administration weakening executive privilege by subpoenaing documents and testimony relating to Joe Biden’s botched withdrawal from Afghanistan or Joe Biden’s involvement in Hunter Biden’s business dealings.
