Joe Biden’s Presidency absorbed another body blow.
This time the defeat came on a key domestic policy agenda item.
And Joe Biden just suffered a crushing loss at the Supreme Court that left Trump smiling.
In a six to three decision, conservatives on the Supreme Court rejected a motion by the Biden administration to stop the Trump administration’s “Remain in Mexico” policy while a lawsuit brought by Texas and Missouri against the administration worked its way through the courts.
“The application for a stay presented to Justice Alito and by him referred to the Court is denied,” the court order read.
Texas and Missouri sued claiming the Biden administration illegally halted the program – which forced asylum seekers to remain in Mexico instead of the government releasing them into the interior of the country while their asylum claims played out.
The Trump administration program ended the practice of catch and release.
Joe Biden rolled this successful policy back and that made the open border nightmare the Biden administration is responsible for even worse.
But the Court stepped in and slammed the brakes on Biden rolling out the welcome sign for illegal aliens with the Supreme Court ruling that the Biden administration was unlikely to prevail on the merits of the case.
“The applicants have failed to show a likelihood of success on the claim that the memorandum rescinding the Migrant Protection Protocols was not arbitrary and capricious. Our order denying the Government’s request for a stay of the District Court injunction should not be read as affecting the construction of that injunction by the Court of Appeals,” the Supreme Court’s order read.
This deals a significant blow to Biden’s attempt to keep the border open as the lawsuit brought by Texas and Missouri will likely take a year to wind its way through the courts.
Democrats are now finding the shoe is on the other foot as liberal judges long used the Administrative Procedure Act to halt Trump initiatives such as rolling back Barack Obama’s executive amnesty scheme for illegal alien children.
This is the same law a federal judge in Texas cited when slapping down the Biden administration’s attempt to roll back the successful “Remain in Mexico” policy.
And the Supreme Court’s ruling that the Biden administration was unlikely to succeed on their appeal forced Joe Biden to keep one of Donald Trump’s immigration policies implemented in the meantime.
