The Supreme Court finally handed down their decision on the Democrats’ demands for Donald Trump’s tax returns.
Both sides were expecting victory.
And John Roberts left Trump stunned with this verdict on his taxes.
The Supreme Court turned in dual 7 to 2 decisions on the Democrats and Manhattan District Attorney Cy Vance’s subpoenas for Donald Trump’s tax returns and other financial records.
And while the Democrats may have won on paper, Donald Trump was the actual winner, because in both rulings the Supreme Court remanded the cases back to lower courts to sort out separation of power issues ensuring that the Democrats will not be able to leak the President’s taxes before the election.
Roberts wrote that the Democrats arguments about their subpoena created unequal branches of government where Congress effectively controlled the President.
“Without limits on its subpoena powers, Congress could ‘exert an imperious controul’ over the Executive Branch and aggrandize itself at the President’s expense, just as the Framers feared,” Roberts stated. “Congressional subpoenas for information from the President … implicate special concerns regarding the separation of powers. The courts below did not take adequate account of those concerns.”
Roberts also held that Manhattan District Attorney Cy Vance’s subpoena was lawful since it pertained to personal records and that even the President could provide evidence in a criminal investigation, but that this subpoena too needed to be relitigated at a lower court.
All in all, these decisions amounted to two wins for the President as the Democrats at the federal and local level will not be able to get their hands on the President’s taxes before the election.
And that was all they cared about.
They just wanted to be able to leak anything they could spin as embarrassing or nefarious to keep driving negative headlines about the President as the election moved along.
