On Friday, a three-judge panel on the Sixth Circuit Court of Appeals dissolved a stay blocking Joe Biden’s unconstitutional federal vaccine mandate.

Barack Obama-appointed Judge Branstetter Stranch wrote for the two-to-one majority that Biden’s un-American power grab can proceed because the “old normal” of life Americans knew in 2019 is never coming back and Americans needed to get used to living in a biomedical security state.

“Recognizing that the ‘old normal’ is not going to return, employers and employees have sought new models for a workplace that will protect the safety and health of employees who earn their living there,” Judge Stranch stated. “In need of guidance on how to protect their employees from COVID-19 transmission while reopening business, employers turned to the Occupational Safety and Health Administration … the federal agency tasked with assuring a safe and healthful workplace.”

Multiple federal judges blocked the vaccine mandate from taking effect on the grounds that the business groups suing the Biden administration were likely to win on the overall merits of the case.

These judges ruled that the administration usurped Congress’s ability to make law by having the Occupational Safety and Health Administration impose a vaccine mandate on businesses with more than 100 workers without the approval of Congress.

Since the Sixth Circuit is deadlocked eight-to-eight on hearing the case En Banc – meaning lawyers on both sides would present their case to the entire court as opposed to just a three-judge panel – the next step for this case is a direct appeal to the Supreme Court to stay Joe Biden’s unconstitutional federal vaccine mandate.

Supreme Court Justices already struck down a similar scheme by Joe Biden when the Centers for Disease Control issued an unconstitutional eviction moratorium.

If the Supreme Court follows that precedent, the six Republican appointees should block Biden’s federal vaccine mandate.
