The clock is ticking on President Joe Biden to come up with a solution to the debt ceiling showdown.
House Republicans passed a common sense bill to raise the ceiling with some modest spending cuts that languished in the Democrat-controlled Senate.
Biden and Democrats are being completely inflexible by refusing to accept any spending cuts to the bloated federal budget.
The President was counting on finding enough RINOs in Congress to fold and pass a no-strings-attached debt ceiling increase.
But the House and a surprising number of Senate Republicans have stood firm against rolling over in the fight.
With the country staring down defaulting on its debt, Biden is reaching deep into his bag of tricks to unilaterally raise the debt ceiling.
The President is floating the blatantly unconstitutional idea of using the 14th Amendment to raise the debt ceiling.
Sen. Ted Cruz (R-TX) gave Biden a reality check over his latest attempt to shred the Constitution during a Fox News appearance.
“I think Biden’s position on the 14th Amendment is legally frivolous,” Cruz said.
The 14th Amendment, passed in the aftermath of the Civil War, contains a section mentioning the public debt.
“That’s a provision that was put in place to say that we’re going to pay our Civil War debts,” Cruz explained. “It refers to the Civil War that we had just fought and paying those war debts off.”
The far-left in Congress have encouraged Biden to use the 14th Amendment to bypass negotiations with the GOP controlled House.
Biden’s own Treasury Secretary Janet Yellen previously said that using it to raise the debt ceiling would spark a “constitutional crisis.”
This blatantly unconstitutional scheme gained prominence under former President Barack Obama during his debt ceiling showdowns with the GOP House.
Cruz pointed out that the move was too far for even Obama to consider.
“By the way, someone else who agreed with that was Barack Obama,” Cruz said. “The Left tried to convince Obama to do this, and Obama said, ‘No, you can’t do this under the Constitution, under the terms of the Constitution.’”
Democrats are hoping to pin the blame for the debt ceiling standoff on Republicans like they did during the Obama regime.
“He could take default off the table,” Cruz continued. “Joe Biden doesn’t want to take default off the table. Why? Because he wants to scaremonger.”
Cruz pointed out that if a debt ceiling increase isn’t passed by the time the government runs out of money that it would be forced to live within its means.
“Once they run out of money, they have to obey what Congress has appropriated,” Cruz said, adding that Biden could simply pay interest on the debt keep from defaulting.
