Democrats are scrambling to put a strategy in place to deal with Ruth Bader Ginsburg’s death.
The headwinds they face in this battle just got even stronger.
And that’s because this video from Joe Biden’s past blew up in the Democrats’ faces.
After Justice Antonin Scalia passed away in February 2016, Barack Obama nominated Merrick Garland to fill his seat.
That was his constitutional prerogative as laid out in Article Two.
Senate Republicans did not even grant Garland a hearing as is their right under Article One to advice and consent on all nominees.
Republicans argued that since Obama was a lame duck President from the other party, the voters should decide who they want to nominate Scalia’s replacement.
That gamble paid off when Donald Trump won the election.
Now, in 2020, Democrats are the ones saying the Republican Senate should block the Republican President’s nominee and let the voters pick.
In a speech in Philadelphia, Joe Biden went so far as to claim that if he won the election, Trump should withdraw his nominee entirely and let him pick Ginsburg’s replacement next year.
But in 2016, Biden sang a different tune.
In an interview with PBS, Biden said the Senate was required to hold a hearing and vote on a President’s nominee.

The American people decided they wanted the Republicans in charge of nominating and confirming Supreme Court Justices by virtue of the results of the 2014, 2016, 2018 elections.
As Joe Biden said in 2016, the President and the Senate must act on a vacancy.
And that gives the GOP the right to fill the seat.
